Employment Terms and Conditions

1. General Employment Terms

1.1 Nature of Employment:
Your employment with KumarSoft  is on an Salary basis, subject to the terms outlined in this agreement. Your employment may be terminated as per the provisions set out in these terms.

1.2 Work Hours:
Your normal working hours will be 48 of hours per week, with workdays from Mon to Sat. These hours may be subject to change based on business needs and operational requirements.

2. Job Responsibilities

2.1 Role and Duties:
As an employee, you will be expected to perform the duties assigned to your role as outlined in the job description and any additional tasks as directed by your supervisor or management. You must adhere to the policies, procedures, and guidelines provided by the Company.

2.2 Standards of Conduct:
You are expected to behave professionally and ethically, maintaining a positive work environment for yourself, your colleagues, and the clients you interact with.

3. Client Relations and Conduct

3.1 Client Stealing:
KumarSoft takes any form of client stealing very seriously. Engaging in actions that involve:

  • Illegally transferring, diverting, or attempting to divert any clients, projects, or business away from KumarSoft for personal gain.
  • Directly or indirectly contacting clients with the intent to solicit or take business away from the Company, whether during your employment or within [insert specific period, e.g., 12 months] after leaving KumarSoft.

is a direct violation of your employment agreement. Any such act will result in immediate termination of employment and may lead to legal action, including claims for damages.

3.2 Client Misbehavior:
KumarSoft is committed to maintaining a professional and respectful environment for all employees and clients. You are expected to:

  • Address any form of disrespectful behavior from clients professionally and promptly report such incidents to your supervisor or HR.
  • Ensure that all interactions with clients are conducted in a polite, respectful, and professional manner.
  • Do not tolerate abusive, discriminatory, or inappropriate conduct from clients. If necessary, escalate the matter to management for appropriate action.

In case of repeated or serious client misconduct, the Company reserves the right to take actions to protect its employees, including but not limited to ending the professional relationship with the client.


4. Colleague Relations and Behavior

4.1 Misbehavior of Colleagues:
At KumarSoft, we promote a collaborative and respectful work environment. Any form of misbehavior by colleagues, including but not limited to:

  • Harassment, discrimination, bullying, or any form of physical, verbal, or emotional abuse.
  • Unprofessional or unethical conduct that disrupts the work environment or creates a hostile atmosphere.
  • Any behavior that is inconsistent with the Company’s values of respect, integrity, and teamwork.

is not tolerated. If you experience or witness any form of colleague misbehavior, it is your responsibility to report the incident to HR or your direct supervisor. The Company will investigate and take corrective action as necessary, up to and including termination of employment for the offending party.

4.2 Conflict Resolution:
If conflicts arise between colleagues, we encourage addressing issues promptly and professionally, either through direct communication or with the assistance of HR or management. The Company will provide support to mediate and resolve any disputes fairly and in a timely manner.


5. Termination of Employment

5.1 Voluntary Termination:
You may terminate your employment by providing [insert number of days] notice in writing to your immediate supervisor.

5.2 Involuntary Termination:
KumarSoft reserves the right to terminate your employment immediately if you are found to have violated any of the terms and conditions outlined in this agreement, particularly regarding client stealing, misbehavior, or failure to maintain professional conduct.

5.3 Grounds for Immediate Termination:
The following actions may result in immediate termination of employment:

  • Theft or attempted theft of client information, company property, or confidential information.
  • Gross misconduct, including but not limited to verbal or physical abuse towards clients or colleagues, harassment, or discriminatory behavior.
  • Serious violations of company policy, including but not limited to security breaches, unethical practices, or fraud.
  • Taking leave without prior approval or notification to the management. Unauthorized absence from work may be treated as job abandonment, leading to termination of employment.


6. Confidentiality and Non-Disclosure

6.1 Confidentiality Obligations:
During the course of your employment, you will have access to confidential company and client information. You agree not to disclose or misuse any confidential information both during and after your employment with KumarSoft.

6.2 Non-Compete and Non-Solicitation Agreement:
You may not solicit or attempt to solicit the business of any client or potential client of KumarSoft for a specified period following the termination of your employment, as outlined in the non-compete clause (if applicable).


7. Disciplinary Action

7.1 Progressive Discipline:
KumarSoft follows a progressive disciplinary process for issues related to performance, conduct, and behavior. However, in cases of serious violations, immediate disciplinary action, including termination, may be applied.

7.2 Investigations and Documentation:
Any claims or reports of client stealing, misbehavior, or misconduct will be thoroughly investigated. All employees are expected to cooperate with internal investigations, and any retaliatory actions for reporting incidents will not be tolerated.


8. Miscellaneous

8.1 Amendments to Employment Terms:
KumarSoft reserves the right to amend, modify, or update the terms of this agreement at any time, with notice provided to you.

8.2 Governing Law:
This agreement shall be governed by and construed in accordance with the laws of GOI.

8.3 Severability:
If any provision of this agreement is determined to be illegal or unenforceable, the remainder of the agreement shall continue in full force and effect.
